Lucrative participation opportunity — not just for influencers!

There is a technically very simple way to take part with us on an affiliate basis.
If you are not yet familiar with it: affiliate means you receive a product link with an attached code (number, word, etc., freely selectable).
You can insert this into your blog, Insta, YouTube channel or anywhere else.
As soon as someone is interested in a product from our shop and uses this link, they not only arrive visibly in our shop, but the affiliate code is invisibly recorded in the shop for the interested party — namely at the time of order and, if the customer creates an account, also in the customer account.

For every purchase made with an affiliate link, we initially provide a standard 10% affiliate commission. This is, of course, negotiable. Influencers with very high reach and great success, who are accustomed to higher rates, are welcome to let us know their expectations.
On the other hand, for some brands with very low margins (for us especially Nature Power and Puravita), we may have to plan for a lower commission, otherwise we would quickly reach a point where we make a loss.
In addition, new customers who purchase via this link will have this affiliate code permanently assigned to their customer account when they save it (a full customer account, not a guest account!), so that our partner benefits from future purchases by that customer even if the customer does not use the affiliate link again.

How can I take part?

Just let us know that you are interested, how you plan to carry out your affiliate activity and, above all, which desired code you would like.
We will then store this desired code in the shop. Done. You can start straight away: simply append "?affiliateCode=MyDesiredCode" to any product or to the shop URL itself and insert it into your blog, Insta or wherever.
At the end of each quarter we compile the successful sales and calculate your affiliate commission based on the net total excluding shipping costs. Businesses will receive this paid into their bank account, private customers will receive a voucher code for future personal purchases.

A tip: You are welcome to use our codes on printed flyers as well. Very long URLs don't look good there. Use T1P to shorten them.

By applying to become an affiliate partner, the prospective affiliate partner accepts the terms and conditions set out below. These also form the contractual basis, so that drafting a separate contract is unnecessary, apart from any ancillary agreements which must be recorded in writing to be valid.

Our Affiliate Terms and Conditions

1. Introduction

The company EnergyVital Naturprodukte GmbH offers an affiliate partner programme in its online shop at www.energyvital.de. The contracting party participates in it as a programme participant (hereinafter Affiliate). The following contractual conditions apply exclusively to all affiliate partner contracts.
Deviating terms and conditions of the participants are non-binding unless they have been expressly accepted in writing by EnergyVital Naturprodukte GmbH.

2. Conclusion of contract

These terms and conditions govern the contractual rights and obligations between EnergyVital Naturprodukte GmbH and the participating affiliates.
The contract is concluded after registration of the participant by acceptance by EnergyVital Naturprodukte GmbH. Contradictory or deviating provisions of these participation conditions require written form. Deviating provisions and/or oral ancillary agreements therefore only apply to the extent that they have been expressly confirmed in writing by EnergyVital Naturprodukte GmbH.
Contractual partners of the partner programme of EnergyVital Naturprodukte GmbH can only be fully legally competent natural persons as well as legal entities.
EnergyVital Naturprodukte GmbH reserves the right to amend these conditions at any time. Participants in the programme will be informed of changes in good time by email.

3. Registration and participation conditions

To participate in the partner programme, the affiliate applies by email (info@energyvital.de). Beforehand they must create a full customer account, which is technically required.
EnergyVital Naturprodukte GmbH must expressly agree to the partnership; only thereafter is the affiliate entitled to promote the offers of EnergyVital Naturprodukte GmbH and to claim the commission. The affiliate has no entitlement to participation in the partner programme.
Only websites that are registered to the applying affiliate, contain a complete imprint in accordance with the applicable legal provisions and whose content does not contravene the law of the Federal Republic of Germany may be registered.
Furthermore, we reserve the right to review the websites. Only websites that correspond to our ethical and moral standards and that do not express extremely unscientific opinions or contain right-wing content and/or hate or agitation will be accepted. For owners of websites that develop in this direction only after registration in our programme, we reserve the right to terminate the cooperation.
The affiliate promotes the offers of EnergyVital Naturprodukte GmbH by embedding hyperlinks or linked advertising banners. The affiliate code is embedded in these, which is automatically assigned in the online shop www.energyvital.de to the purchase or to the account of the purchasing customer when the customer buys.
A commission is only credited upon purchase. The amount of this commission is, as standard, 10% of the purchase price net and excluding shipping costs, but can also be negotiated individually.
The nature of the recurring commission is tied to the respective customer account of the buyer. If the buyer creates a new account at the next purchase despite the existence of an account and without using the affiliate link, no commission allocation can be made. It is therefore in the interest of the affiliate to encourage their customers or followers to always use the same customer account and not to create guest accounts (automatically the case when using PayPal Express Checkout and when the customer clicks "do not create a customer account" during the checkout process). We are not liable if the customer does not adhere to this and creates a new account, which prevents allocation of the recurring commission.
Furthermore, on request the affiliate can receive personalised vouchers (coupon codes) with different properties or discount percentages for individual use. To prevent abuse through distribution of this code independent of the affiliate, it may only be passed on in masked form, e.g. as a shortened URL to be created via https://t1p.de. If abuse is detected, e.g. by the appearance of the code on publicly accessible voucher portals, this code will be deactivated.
Participation in the partner programme is free of charge for the affiliate.
As soon as EnergyVital Naturprodukte GmbH agrees to an affiliate's participation in the partner programme, we activate usability. The applicant receives their affiliate code in the form of a prefix (?affiliateCode=MyDesiredCode), which they append to the desired shop URLs of our online shop. Integration of the promotional links is the sole responsibility of the affiliate. This also applies to placement and labelling, the frequency of inclusion and similar questions. The correct technical integration to ensure proper accounting is the responsibility of the affiliate. EnergyVital Naturprodukte GmbH accepts no liability for disadvantages suffered due to incorrect integration by the affiliate.
The affiliate is not entitled to modify the advertising links (HTML codes) provided to them in any way, for whatever reason or purpose. The affiliate is also not permitted to integrate the advertising materials into emails whose recipients have not expressly consented to receive these emails (spam).
The affiliate undertakes to keep their contact details stored with EnergyVital Naturprodukte GmbH, in particular their email address and bank account details, up to date at all times. Disadvantages suffered by the affiliate due to delayed information as a result of inadequate or outdated contact details are their sole responsibility.

4. Payment of commissions

Sales recording and calculation of commissions is carried out by us.
An affiliate's claim to commission exists only if EnergyVital Naturprodukte GmbH has declared the commission released. The release of the commission and the associated credit to the affiliate's commission account takes place quarterly or, at the affiliate's request, monthly (provided that more than €20 commission is generated monthly) after successful fulfilment of the purchase contract between the referred buyer and EnergyVital Naturprodukte GmbH. Credit balances on commission accounts at energyvital.de do not accrue interest.
Commissions from the commission account for private customers without a business licence who participate in the affiliate programme are paid out by voucher codes or offset against goods purchases.
If EnergyVital Naturprodukte GmbH terminates the partner programme, the balance of the commission account will be paid out on the 1st of the following month.
For the calculation of the commission, sales are taken into account when the sale, delivery and full payment of the goods have been completed. The calculation is based on the net shopping basket value, less shipping costs and any cancellations.

5. Duration and termination of the contract

Agreements concluded on the basis of these conditions between the contracting party and EnergyVital Naturprodukte GmbH are valid for an indefinite period.
The affiliate is entitled to terminate the cooperation with EnergyVital Naturprodukte GmbH at any time. If the affiliate ends the cooperation with EnergyVital Naturprodukte GmbH, any outstanding balance of the affiliate will be settled.
Termination of cooperation with EnergyVital Naturprodukte GmbH by the affiliate is possible at any time by email to info@energyvital.de. Any termination is effective immediately. From the time of termination onwards, the affiliate's advertising successes will no longer be counted or taken into account for the calculation of entitlement to commissions.
EnergyVital Naturprodukte GmbH is entitled to terminate the cooperation with the affiliate at any time. If EnergyVital Naturprodukte GmbH ends the cooperation with the affiliate, any outstanding balance of the affiliate will be settled.

6. Data protection

The participants' data are stored by EnergyVital Naturprodukte GmbH for contract processing and for communication within the partner programme. They are used only in the context of contract fulfilment and are neither passed on to third parties nor used for advertising purposes.

7. Amendment of these terms and conditions

EnergyVital Naturprodukte GmbH is entitled to amend and adapt these terms and conditions during the ongoing membership. EnergyVital Naturprodukte GmbH will send the amended conditions to the contracting parties by email in text form and will point out the new regulations in particular. At the same time, EnergyVital Naturprodukte GmbH will give the contracting parties a reasonable period in which to declare whether they accept the amended terms and conditions for further use of the services. If no declaration is made within this period, the amended terms and conditions shall be deemed to have been agreed. EnergyVital Naturprodukte GmbH will expressly point out this legal consequence to the contracting parties at the start of the period. If a contracting party objects to the amendment of these terms and conditions, EnergyVital Naturprodukte GmbH is entitled to terminate the contract without notice at the time the amended terms and conditions come into force.

8. Final provisions

The place of performance for all obligations and the place of jurisdiction for all disputes arising from the contractual relationship is, insofar as the contracting party is a merchant or a legal entity under public law, Dresden.
Only the law of the Federal Republic of Germany applies, excluding private international law and the UN Sales Convention. Excluded from this are claims in the field of industrial property rights and copyright.
The possible invalidity of a provision of these terms and conditions does not affect the validity of the remaining terms and conditions.
